Eckhart, a former associate producer for the web connection, alleged that Henry sexually harassed and raped her.
Henry, who now works at Newsmax, has claimed that the sexual relations with Eckhart were consensual.

A trial is scheduled to start May 12.
The judge cited three instances in 2014, 2015 and 2016.
No corporation should be allowed to protect predators while punishing survivors who dared to speak up.
An attorney for Henry did not immediately return a request for comment.
But the judge wrote that such questions should be left to a jury.
The judge added, There is no evidence that refutes Eckharts assertion that the three sexual incidents were nonconsensual.
But those messages could be read in other ways too.
A reasonable jury could believe those accounts and infer that Henry engaged in similar misconduct with Eckhart.
That included a September 2015 incident in which Eckhart performed oral sex on Henry in the Fox News office.
But the judge wrote, that no reasonable jury could find Fox News liable based on that evidence.
Fox News said in a statement, We are pleased with the courts decision which speaks for itself.
The only people who know what happened between Mr. Henry and Ms. Eckhart are the two of them.
